Senator Dave Min Urges Prosecution of California Participants of Trump-incited Capitol Rampage

Min to Attorney General Becerra, District Attorney Spitzer: “It is imperative that our California law enforcement work closely with federal authorities to uphold our rule of law.”

IRVINE, CA — Today, Senator Dave Min (D-Irvine) sent a letter to California Attorney General Xavier Becerra and Orange County District Attorney Todd Spitzer urging prosecution to the full extent for insurrectionists who participated in the attempted coup of the U.S. Capitol last Wednesday.

“Like many of you, the events on January 6 shook me to my core as a former U.S. Senate staffer and as a patriotic American,” Min said. “Let me be clear. The assault on the U.S Capitol Building, long seen as as the seat of our federal republic and the symbol of American democracy, was an attack on the United States of America.”

“I was concerned to learn that a number of Orange County residents were identified as being potentially part of the planning and execution of this terrorist attack. I know that many of my constituents are deeply worried about the terroristic threat these extremists pose to our community. I am asking for a private briefing on the status of state and local investigations into the role played by residents of California and Orange County in this attempted coup, and I am urging that any who participated in these criminal acts be prosecuted to the full extent allowed under California law.”

Senator Min’s letter specifically called for investigation and potential prosecution for Conspiracy under Section 182 of the California Penal Code, which makes it a crime for two or more people to conspire to commit any crime against the Vice President of the United States or any senior federal official, or to commit or assist in murder, kidnapping, assault with a deadly weapon, threatening or obstructing government officials, rioting, and vandalism.

Dave Min represents California State Senate District 37, which is located in Orange County and includes the communities of Anaheim, Costa Mesa, Foothill Ranch, Huntington Beach, Irvine, Laguna Beach, Laguna Woods, Lake Forest, Newport Beach, Orange, Tustin, and Villa Park.

Dave was a University of California Irvine law professor and a former economic policy staffer in the United States Senate and for the Center for American Progress. He began his legal career at the Securities and Exchange Commission to protect the retirement security of seniors, turning down high paying jobs to serve the public interest.
